Terms of Service
Effective 2 September 2026
These terms are an agreement between you and Shapen, LLC (“Shapen”, “we”, “us”). They apply to shapen.com, the Shapen editor and assistant, and everything we provide through them (the “Service”). By creating an account or using the Service you agree to them.
1. Who can use the Service
You must be at least 18 years old and able to enter a binding contract. If you use the Service for an organisation, you confirm you are authorised to accept these terms on its behalf.
2. Your account
You sign in with a code sent to your email address or with a Google account. Keep your email account secure: anyone who can read it can sign in as you. Tell us at support@shapen.com if you believe your account has been used without your permission. You are responsible for what happens under your account.
3. What the Service does
Shapen lets you upload media, describe what you want, and have video, images, stories and captions generated by artificial intelligence models, then edit the result in a browser-based editor and export it. Generation runs on models operated by third parties (listed in our Privacy Policy). Their output can be inaccurate, unexpected, or similar to output produced for other people. Review everything before you rely on it or publish it.
4. Credits, plans and payment
- Generations cost credits. The price of each kind of generation is shown in the editor before you start it, and the assistant states the cost of a plan before carrying it out.
- Every account receives a small free allowance of credits that refills over each trailing 24 hours. We may change the allowance at any time.
- A Pro subscription adds a monthly allowance of plan credits. Unused plan credits expire at the end of each billing period and do not roll over. The subscription renews automatically each month until you cancel it, which you can do at any time from the billing portal in the app; you keep your plan credits until the period you have paid for ends.
- We may add credits to your account as a gift, for example after a support issue. Gifted credits have no cash value and may carry an expiry date that is shown in the app.
- Payments are processed by Stripe under its own terms. We do not store your full card details.
- If a generation fails, the credits it used are returned to you automatically. Apart from that, and except where the law requires otherwise, credits and subscription fees are not refundable, and credits cannot be exchanged for money or transferred to another account. If you dispute a payment, or a payment is refunded, we may remove the credits that payment bought.
- We may change prices and what a plan includes. Changes to a subscription price take effect from your next billing period, and we will tell you before they do.
5. Your content
You keep whatever rights you have in the media, prompts and text you upload or write (“your content”) and, to the extent permitted by law and by the model providers’ terms, in what the Service generates for you from it (“output”). To run the Service we need your permission to store, copy, process, transmit and display your content and output, including sending it to the model providers we use to generate output for you. You give us that permission for as long as the content remains in your account. We do not use your content or output to train our own models.
You are responsible for your content and output. You confirm that you have the rights needed to upload your content and to use the output as you intend, including the rights of anyone who appears in it.
6. Publishing and remixing
When you publish a project it appears on Explore, where anyone can view it, and other users can remix it: that creates a copy of the project, including its media, story elements and description, in their own account. By publishing you allow that, and you allow us to show the project, its preview image and your display name and profile picture publicly. Unpublishing removes the project from Explore but does not remove copies people already made.
7. What you may not do
Do not use the Service to create, upload or publish content that:
- is illegal, or that you do not have the right to use;
- sexualises minors, or shows intimate imagery of a real person without their consent;
- depicts a real person in a misleading way that could deceive others about what they said or did, or impersonates someone;
- harasses, threatens or incites violence against a person or group;
- infringes a copyright, trademark, privacy or other right.
Do not:
- access the Service by automated means, or interfere with it, its limits or its security measures;
- resell the Service, share an account, or use several accounts to obtain more free credits;
- try to extract or reverse-engineer the models, prompts or software behind the Service.
The model providers we use apply their own content rules, and a generation they refuse is refunded. We may remove content, refuse generations, or suspend or close accounts that break these terms, and we may report illegal content to the authorities.
8. Our rights
The Service, including its software, design and name, belongs to us or our licensors. These terms do not give you any right to it beyond using it as intended. If you send us feedback, we may use it without obligation to you.
9. Ending your account
You can stop using the Service at any time and ask us to delete your account by writing to support@shapen.com. We may suspend or close your account if you break these terms, if we must for legal reasons, or if we discontinue the Service; where practical we will give you notice and a chance to export your projects. Sections 4 to 12 continue to apply after your account ends.
10. Availability and disclaimers
We provide the Service as it is and as it is available. We do not promise that it will be uninterrupted or error-free, that output will be accurate or suitable for any purpose, or that projects, media or output will be retained. Keep your own copies of anything important. To the fullest extent the law allows, we exclude all warranties that are not expressly stated in these terms.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for lost profits, data or goodwill, arising from the Service or these terms, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
12. Changes, law and contact
We may update these terms. If a change is material we will tell you in the app or by email before it takes effect; continuing to use the Service after that means you accept the new terms. These terms are governed by the law of the State of Delaware, and its courts have jurisdiction over any dispute, without affecting rights you have as a consumer where you live.
